TreeTimber LLC – Terms and Conditions of Service
By accepting services from TreeTimber LLC, the Customer agrees to all terms and conditions outlined below. This agreement serves as a binding contract between TreeTimber LLC, its vendors, subcontractors, and the authorizing party (Customer and/or Customer’s Agent).
1. Scheduling & Cancellation Policy
TreeTimber LLC will make every reasonable effort to perform work on the earliest scheduled date possible. However, scheduling is contingent upon weather, equipment availability, labor conditions, and unforeseen delays. TreeTimber LLC shall not be held liable for any damages, direct or indirect, resulting from such delays.
Cancellations must be made at least 24 business hours in advance of the scheduled service. If cancellation occurs within 24 hours or after a crew has been dispatched, a $400 mobilization fee will be applied. This fee covers operational and logistical costs.
2. Safety & Work Zone Access
TreeTimber LLC operates under strict safety guidelines and follows all current industry safety standards. We maintain a Zero Tolerance Policy for reckless endangerment or unsafe interference.
The Customer agrees to never enter the work zone during active operations. Any violation of this term may result in:

Immediate job termination

The Customer remaining liable for full payment of the contracted amount

The breach being classified as a violation of contract and negligent endangerment of TreeTimber personnel
3. Property & Lawn Damage Disclaimer
Tree work may require access over lawns, driveways, or landscaping. While reasonable care will be taken to minimize damage, the Customer understands and agrees that TreeTimber LLC, its employees, or subcontractors shall not be held responsible for:

Ruts, tire marks, or indentations in soft or wet ground

Cracked pavement, sidewalks, or driveways caused by equipment weight

Damage to flower beds, shrubs, sod, or landscape features
-
Damage caused by falling branches, limbs, trunk sections, or mechanical equipment in the course of work
4. Underground Utilities Disclaimer
TreeTimber LLC is not responsible for damage to unmarked underground utilities or systems, including but not limited to:

Irrigation or sprinkler lines
-
Drainage pipes
-
Septic tanks
-
Cables, wires, or fiber optics
-
Invisible fencing
It is the Customer’s sole responsibility to accurately map and mark all underground systems prior to the start of work. A copy must be presented to and signed by the crew leader. Failure to do so waives TreeTimber of any liability related to such systems.
5. Delays & Force Majeure
In the event of delays due to inclement weather, hazardous conditions, limited access, labor shortages, or any events beyond TreeTimber’s control, TreeTimber LLC shall not be held liable for any consequential or incidental damages, lost time, or inconvenience. Such delays do not relieve the Customer of contractual obligations, including job completion and full payment.
6. Defamation, Blackmail, & Reputation Protection
By engaging TreeTimber LLC, the Customer agrees to resolve all service disputes privately through written communication.
The Customer agrees not to publish any false, slanderous, or malicious reviews with the intent to damage TreeTimber LLC’s reputation. Any such attempt will trigger a $5,000 Cease and Desist Processing Fee, enforceable by legal means under business defamation and tort laws.
7. Payment Terms & Fees

Accepted Forms of Payment: Cash, Zelle, or Cash App

Checks, PayPal, or Credit Card (if available): 12% processing fee

Full payment is due immediately upon completion of services

If payment is delayed by more than 3 minutes, the Customer agrees to pay a $200 Job Delay Fee, due to negative impact on scheduling, crew efficiency, and reputation

Returned Checks: $100 fee for insufficient funds
-
Failure to remit payment as agreed may result in a $1,000 Late Court Processing Fee, along with all costs of collection, legal fees, and interest
8. Non-Refundable Deposits
All security deposits paid to TreeTimber LLC are strictly non-refundable, with no exceptions, regardless of the reason for cancellation, change in scope, or project postponement.
9. Consultation Policy
The first 15 minutes of any estimate or on-site consultation provided by TreeTimber LLC are complimentary. Any consultation exceeding 15 minutes will incur a $100 detailed consultation fee, unless:

The fee is formally waived by a TreeTimber site manager, or
-
TreeTimber LLC proceeds to begin work on the requested project at the time of consultation
10. Limitation of Liability
TreeTimber LLC shall not be held liable for:

Any incidental, indirect, or consequential damages

Injury or property loss occurring before, during, or after services
-
Any loss caused by the Customer’s failure to follow safety guidelines or disclose property conditions
All liability, if any, shall be limited strictly to the amount paid by the Customer for the specific service in question.
11. Legal Governance
This agreement shall be governed by and interpreted under the laws of the State of Florida. Any legal disputes shall be resolved exclusively in Volusia County, Florida.
