Tree Timber LLC Terms and Conditions of Service
Tree Timber LLC provides professional tree removal, tree trimming, hazardous tree work, and property safety services across Volusia County and Seminole County, Florida. By hiring Tree Timber LLC, the Customer agrees to the Terms of Service below. These terms form a binding contract between Tree Timber LLC, its subcontractors, and the Customer or the Customer’s Agent.
This page outlines our tree service policies, property protection guidelines, safety rules, and liability limitations, which are standard for professional tree contractors in Florida.
1. Scheduling and Cancellation Policy
Tree Timber LLC schedules all tree removal, tree trimming, and land clearing services based on weather, equipment availability, and safe working conditions.

Scheduling dates are approximate and may shift due to weather or job conditions.

Tree Timber LLC is not liable for any delays related to storms, winds, rain, or equipment issues.

Cancellations must be made at least 24 business hours in advance.

Late cancellations or dispatch cancellations incur a $400 Mobilization Fee.
This policy protects scheduling efficiency for our tree service teams serving Volusia and Seminole County.
2. Safety and Work Zone Access
Tree Timber LLC follows strict tree industry safety standards and OSHA compliant procedures.
Customer agrees to:

Stay outside the active work zone

Keep children and pets indoors

Remove vehicles from fall zones

Avoid giving conflicting instructions to workers

Any interference results in:

Immediate job termination
-
Full payment still due

Customer held liable for safety violations
These safety rules protect both the Customer and Tree Timber LLC during hazardous tree work.
3. Property and Lawn Damage Disclaimer
Our equipment includes aerial lifts, chainsaws, rigging gear, skid steers, and heavy trucks. Tree Timber LLC is not liable for:

Lawn ruts or ground compression

Driveway, sidewalk, or paver cracking

Damage to sod, mulch beds, shrubs, or landscaping

Debris impact from falling limbs or trunk sections
-
Damage caused by equipment access routes
These disclaimers are standard for tree removal contractors in Florida, especially when removing large or hazardous trees.
4. Underground Utilities and Hidden Systems
Tree Timber LLC is not responsible for damage to unmarked underground utilities, such as:

Sprinkler lines

Septic tanks or drain fields

Invisible fencing

Fiber optic lines
-
Private utilities or abandoned lines
Customer must mark all underground systems.
Failure to do so waives all liability from Tree Timber LLC.
This clause protects your property and ensures safe tree root removal and stump-related services.
5. Hazardous Tree Risk and Directional Fall Waiver
Florida’s climate produces unstable trees due to storms, hurricanes, rot, and soil erosion.
Customer acknowledges that hazardous trees may:

Split unpredictably

Fall in unintended directions
-
Collapse during cuts
-
Shift due to internal decay
-
Lose structural integrity during removal
Tree Timber LLC is not responsible for property impact caused by the natural behavior of hazardous trees.
This waiver is essential for high-risk tree removal in Florida.
6. Pre-Existing Condition Release
Tree Timber LLC is not liable for issues caused by:

Termite-damaged trees
-
Hollow trunks
-
Rotten roots
-
Dead or declining trees
-
Weak branch attachments
-
Structural deformities
These conditions often exist before arrival and increase risk during tree removal or trimming.
7. Neighbor Property, Boundary Lines, and Airspace
Tree Timber LLC is not liable for any property impact or disputes involving neighbors.
Customer is responsible for:

Getting neighbor permission if access is required

Handling all neighbor disputes

Accepting liability for debris crossing property lines
This is standard for tree removal near fences, tree trimming on property lines, and shared boundary trees.
8. Customer Interference Liability
Tree Timber LLC voids all liability if Customer:

Enters the work zone
-
Touches equipment
-
Gives unsafe instructions
-
Blocks equipment access
-
Interrupts operational procedures
Customer becomes fully responsible for damages or injuries resulting from interference.
9. Delays and Force Majeure
Tree Timber LLC is not responsible for delays caused by:

Severe weather
-
Wind gusts
-
Storm conditions
-
Road restrictions
-
Mechanical issues
-
Emergency storm-response jobs
Work will resume once conditions are safe and equipment is available.
10. Debris Removal, Dump Loads, and Cleanup Policy
If cleanup is included:

Dump loads are billed at $500 per load
-
Partial loads count as full loads
-
Crew leader’s measurement is final
If Customer chooses cut-only service, all debris becomes Customer responsibility.
This is standard for budget tree removal and DIY cleanup options.
11. Defamation, Review Policy, and Reputation Protection
Tree Timber LLC resolves disputes privately.
Customer agrees not to publish:

False claims

Misleading reviews
-
Defamatory statements
-
Threats or extortion attempts
Violation results in a $5,000 Defamation and Cease-and-Desist Processing Fee.
This protects our reputation as a licensed and insured tree service serving Volusia County.
12. Payment Terms and Fees

Credit cards or PayPal (if available):

12% processing fee
Payment is due immediately upon completion.
Additional fees:

$200 Job Delay Fee (late payment)

$100 Returned Check Fee

$1,000 Late Court Processing Fee for nonpayment
13. Non-Refundable Deposits
All deposits for scheduled tree work are non-refundable under all circumstances, including weather, rescheduling, and Customer-requested changes.
14. Consultation Policy
Tree Timber LLC provides the first 15 minutes of consultation free.
After 15 minutes, a $100 consultation fee applies unless waived in writing.
15. Photo, Video, and Drone Documentation
Customer authorizes Tree Timber LLC to take photos and videos for:

Documentation

Proof of work
-
Safety
-
Training
-
Marketing
-
Insurance purposes
This is standard for professional tree service companies.
16. No Warranty Clause
Tree Timber LLC does not guarantee:

Tree health
-
Future safety
-
Soil stability
-
Long-term outcomes after trimming or removal
-
Behavior of remaining trees during storms
17. Limitation of Liability
Tree Timber LLC is not responsible for:

Indirect or consequential damages

Soil settling
-
Landscape shifting
-
Pest disturbance
-
Root movement
-
Customer negligence
-
Neighbor disputes
-
Natural hazards
-
Environmental conditions
Total liability, if any, is limited strictly to the amount paid for the specific service.
18. Legal Governance
These Terms are governed by Florida law.
All disputes will be handled exclusively in Volusia County, Florida.
